Applicant is a priest of the C.A.C in charge of the branch in Idaw layout, Enugu. Respondent is the registered trustee of the church in Nigeria.
Following some dispute between the two, the respondent sacked the applicant and demanded that he vacate the church house.
The applicant then instituted an action which was also countered by the respondent requesting an order compelling the defendant to vacate the premises allocated to him and render account as well as hand over all the church property in his possession.
The two cases were consolidated for trial.
Later in the life of the suit, respondent filed a motion asking the court to order the appellant to vacate the premises as well as restraining the defendants and his agents from entering the church premises. The court so ordered but refused to order the applicant to render account of and hand over the respondent's property in his possession.
Applicant dissatisfied went to the Appeal court and subsequently filed an application for stay of proceedings and stay of execution of the order contained in the ruling of the High court.
